A woman who was punched repeatedly by a California Highway Patrol (CHP) officer in an incident caught on film earlier this year will receive $1.5M as part of a settlement reached Wednesday.
CHP Commissioner Joe Farrow announced the settlement in an emailed statement and an attorney for 51-year-old Marlene Pinnock confirmed the deal to the Associated Press. The agreement was reached after nine hours of mediation in Los Angeles.
As part of the agreement, the officer who struck Pinnock, Daniel Andrew, has agreed to resign.
Pinnock's attorney, Caree Harper, says they wanted to make sure the woman could have financial stability for the rest of her life and wanted to make sure that Andrew would not be an officer any longer.
The incident occurred July 1, when Pinnock was spotted walking along the shoulder of Interstate 10 in Los Angeles. She told the Associated Press last month that she was walking to a place frequented by the homeless where she felt it was safe to sleep. Pinnock said she had been homeless for the last three to five years, occasionally staying at a shelter, a family member's home or living on the streets.
The CHP said that Pinnock had been endangering herself while walking on the side of the freeway and the officer had attempted to restrain her. 'He grabbed me, he threw me down, he started beating me, he beat me. I felt like he was trying to kill me, beat me to death,' Pinnock told The Associated Press on Sunday.
Pinnock had sued the CHP for civil rights violations, alleging excessive force, assault, battery and a violation of her due-process rights. At the time of the incident, Andrew had been on the force for a year and a half, and had been relegated to desk duty during an internal investigation.
